Assistant Attorney General - Civil Division

The Office of the Kansas Attorney General’s Civil Division operates as a general-service law firm for the State of Kansas and agencies. We provide legal advice as general counsel to agencies across State government, we represent State agencies, institutions of higher education, and employees sued in state and federal court for personal injuries, property damage, employment discrimination, and more.

Position Summary & Responsibilities

The Civil Division houses attorneys in three sections: Defensive Litigation, Affirmative Civil Enforcement (ACE), and Legal Oversight & Government Counsel (LOGiC). A position is currently available in Defensive Litigation and Affirmative Civil Enforcement (ACE) sections.

Affirmative Civil Enforcement (ACE): This section litigates cases where the State will appear as the plaintiff, affirmatively asserting and protecting State interests. This practice involves a wide range of plaintiff-oriented cases such as false claims, breach of contract, illegal annexations, enforcement actions on behalf of the State of Kansas, representing state agencies in administrative disciplinary/licensing matters, ensuring Kansas’ compliance with the Tobacco Master Settlement Agreement (MSA), and pursuing judgments on behalf of the state. The Assistant Attorney General will litigate cases with a team with other attorneys, one special agent, and administrative support professionals.

Defensive Litigation: Attorneys in this section defend the State of Kansas and its agencies in all manner of defensive litigation: torts, employment suits, prisoner litigation, wrongful conviction claims, contract disputes, civil rights claims, appeals from administrative decisions, and a host of other civil claims. They handle cases all the way through motions practice, discovery, settlement negotiations, and trial as necessary.

PRIMARY DUTIES

  • Drafting/arguing pleadings and motions; investigating potential cases;
  • Interviewing clients and witnesses;
  • Legal research and writing;
  • Conducting depositions;
  • Conducting negotiations;
  • Participating in administrative hearings;
  • District court trial advocacy;
  • Researching, interpreting, and applying statutes, court decisions, or other legal authority on points of law;
  • And overseeing personal case management.

TRAVEL

Infrequent to occasional travel both within and outside the state of Kansas for meetings, depositions, hearings, trials, training, and other investigation- and litigation-related duties will be required.


QUALIFICATIONS

Licensing & Certification

  •  Certificate of admission and membership in good standing with the Bar of the Supreme Court of Kansas or eligible for admission on waiver (or Kansas Supreme Court Rules for Attorney Admissions – Rule 715)
  •  A valid driver’s license

Preferred Qualifications

  • Prior experience or demonstrated interest in the Civil Division's mission/work

Attorneys

Attorneys employed with the OAG are designated as Deputy Attorneys General, Assistant Attorneys General, or similar. Our attorneys specialize in the practice of various fields of law including administrative, antitrust, civil litigation, criminal litigation, employment, and environmental to name just a few.

Minimum Qualifications

  • Graduation from an accredited law school
  • Admission to and membership in good standing with the Bar of the Supreme Court of Kansas
  • Admission to or eligibility for admission to the U.S. District Court for the District of Kansas and U.S. Court of Appeals for the Tenth Circuit

Special Agents

Commissioned law enforcement personnel who conduct civil and/or criminal investigations and perform other law enforcement duties.

Minimum Qualifications

  • Current or past full-time law enforcement certification
  • Three (3) years of law enforcement experience

Investigators

Civilian personnel who gather information, conduct interviews and manage a caseload of civil matters or complaints. No law enforcement duties are associated with these positions.

Minimum Qualifications

  • Graduation from an accredited four-year college or university with major course work in business administration, communications, criminal justice, or related field(s)
  • Related professional or technical experience may be substituted for the required college study

Information Technology (IT)

IT is critical to the efficient and effective operations of the OAG. Areas of specialty include database administration, network monitoring and maintenance, IT security and end-user support.

Administration/Clerical

Administrative and clerical staff are needed to support the mission of the OAG. These include positions such as accountants, legal assistants and clerical positions with increasing levels of complexity and responsibility. Many of these positions provide support to the administrative, investigative and/or legal functions of the agency.

In accordance with K.S.A. 75-3111 and K.S.A. 75-2935(1)(j), officers and employees in the OAG are in the unclassified service of the Kansas Civil Service Act. Unclassified positions are not subject to the entitlements provided to employees in the classified service as defined by the Kansas Civil Service Act. Employees of the OAG serve at the pleasure of the Attorney General and are terminable at-will.
