Kobach to appeal of district court ruling blocking protections for children

TOPEKA – (May 16, 2026) – Kansas Attorney General Kris Kobach announced today that his office will appeal a preliminary injunction temporarily blocking enforcement of key provisions of Senate Bill 63. 

“This is a stark example of judicial activism,” Kobach said. "The judge invented a new constitutional right out of whole cloth. Even though the Kansas Constitution says nothing about it, the judge created a new right of parents to obtain otherwise-illegal treatments for their children.” 

SB 63, known as the "Help Not Harm Act," enacted by the Kansas Legislature, and signed into law in 2025, prohibits healthcare providers from administering puberty blockers or cross-sex hormones to minors for the purpose of gender transitioning. Lawmakers overrode a Governor's veto of the law, which was designed to protect Kansas children from experimental and irreversible medical interventions.

In the case of Loe v. State of Kansas, a Douglas County District Court Judge granted a temporary, statewide injunction against the law’s prohibitions on these treatments, allowing their continued use on minors pending further litigation.
