Roofing Registration

The Kansas roofing registration act (“KRRA”) is a set of statutes enacted by the Legislature in 2013.  Generally, the KRRA requires roofing contractors to apply for and receive a roofing contractor registration certificate before performing commercial or residential roofing services for a fee in Kansas.

Every “roofing contractor,” with few exceptions, must obtain a roofing contractor registration certificate in order to legally perform commercial or residential roofing services for a fee in Kansas.  As of July 1, 2013, it is illegal for any person or business to provide roofing services in Kansas unless that person or business has a valid certificate or meets one of the narrow exemptions in the KRRA. As of July 1, 2015, “general contractors” who meet certain criteria are exempted from the registration requirements. See below for more information.

The Kansas roofing registration act defines a roofing contractor as

 “any person, including a subcontractor and nonresident contractor, who in the ordinary course of business:

(A) Engages in the business of commercial or residential roofing services for a fee; or

(B) offers to engage in or solicits roofing-related services, including construction, installation, renovation, repair, maintenance, alteration and waterproofing.”

As of July 1, 2015, general contractors who meet the criteria outlined in 2015 HB 2254 are not required to register. The attorney general may request proof from the general contractor that he or she meets the qualifications for exemption. A general contractor may request the attorney general issue a letter of exemption stating that the contractor meets the qualifications for exemption by contacting our office.

In general, Kansas roofing contractor registration certificates remain valid for one year. Each certificate expires on June 30, and each roofing contractor must renew its registration on or before July 1 every year.

Yes. Violations of the Kansas roofing registration act are punishable by civil penalties of up to $10,000 per violation plus other forms of relief. Any violation of the KRRA is considered a deceptive or unconscionable act or practice under the provisions of the Kansas Consumer Protection Act, K.S.A. 50-623, et seq. A roofing contractor registration certificate may be revoked for noncompliance with the Kansas roofing registration act.

The Attorney General administers the KRRA.

The Kansas Attorney General’s Office reviews applications submitted by those seeking to obtain roofing contractor registration certificates. If the application is complete, accurate, and accompanied by the appropriate supplemental documents, then the Attorney General will issue a roofing contractor registration certificate to the applicant.

Yes. The Office of the Attorney General may revoke a roofing contractor registration certificate for noncompliance with the Kansas roofing contractor registration act.

Tax Clearance Certificates can be requested from the Kansas Department of Revenue, the website is http://www.ksrevenue.org/index.html. Each applicant is required to provide a valid Tax Clearance Certificate, or a letter from the Kansas Department of Revenue, along with the completed application for a roofing registration certificate.

A Certificate of Liability Insurance can be obtained from your insurance company. Each applicant is required to provide a valid Certificate of Liability Insurance along with the completed application for a roofing registration certificate. Please note that the liability insurance policy shall not be less than $500,000.

A Certificate of Workers Compensation Coverage can be obtained from your insurance company. Each applicant is required to provide a valid Certificate of Workers Compensation Coverage along with the completed application for a roofing registration certificate.

No. A roofing contractor registration certificate may not be shared between roofing contractors. Roofing contractor applicants must list on the application each person authorized to act on behalf of the registrant.
