Winfield woman sentenced for Medicaid fraud in Osage County

LYNDON – (July 22, 2014) – A Winfield woman was ordered yesterday to repay more than $5,000 to the Kansas Medicaid program after pleading no contest to Medicaid fraud charges, Kansas Attorney General Derek Schmidt said.

Sherry Benson, 41, was ordered to repay $5,357 to the Medicaid program by District Judge Phillip M. Fromme in Osage County District Court. Benson pleaded no contest in May to one count of making a false claim to the Medicaid program and one count of felony theft. In addition to the restitution, Benson was sentenced to 12 months of probation with an underlying sentence of 8 months in prison.

The state alleged that Benson was employed as a personal care attendant and billed the Medicaid program for more than 400 hours of services not provided between August and September 2012. The Medicaid beneficiary Benson claimed to be caring for was incarcerated in Oklahoma during the time she billed these services.

The case was investigated by the attorney general’s Medicaid Fraud and Abuse Division. Assistant Attorney General John Bryant of Schmidt’s office prosecuted the case.
