AG Derek Schmidt announces settlement with Board of Education U.S.D. 361 over KOMA violation

TOPEKA – (April 14, 2017) – Kansas Attorney General Derek Schmidt today announced a settlement with the Board of Education of U.S.D. 361, Anthony-Harper to resolve a violation of the Kansas Open Meetings Act (KOMA).

In June 2016, the attorney general’s office received a complaint alleging the Board violated the KOMA. The allegation involved the Board reaching a consensus during executive session but not holding a public vote approving their consensus decision. Upon investigation, the attorney general’s office determined that the Board of Education violated the KOMA by taking binding action during a closed or executive session.

At the conclusion of the investigation, the members of the Board of Education signed a Consent Order agreeing to each pay a civil penalty of $50, undertake a prompt review of Board policies and not engage in any future violations of the KOMA. The board members already have received open government training since the violation.
