Oklahoma woman permanently banned from doing business in Kansas

TOPEKA – (June 12, 2020) – An Oklahoma woman who operated a door-to-door paving company has been permanently banned from doing business in Kansas, Attorney General Derek Schmidt said today.

Linda Curry, of Enid, Oklahoma, d/b/a Midwest Asphalt, was permanently banned from doing business, including operating as a door-to-door salesman, in the State of Kansas. District Judge Teresa Watson yesterday approved the default judgment in Shawnee County District Court after Curry failed to respond to a lawsuit the attorney general filed against her. Curry was also ordered to pay $4,000 in consumer restitution, $100,000 in civil penalties and the cost of the attorney general’s investigation.

Schmidt accused Curry of contracting with at least one Kansas consumer for asphalt and paving services. Curry did not inform the consumer of the price of the job before beginning the job, represented she would pave the entire driveway and only completed part of the job, demanded full payment and then represented she would finish the job and subsequently did not return. Curry also failed to comply with provisions of the Kansas Consumer Protection Act relating to door-to-door sales and engaged in deceptive and unconscionable practices.

Yesterday’s judgment follows a February judgment in Jackson County District Court involving the same company against Billy Curry also d/b/a Midwest Asphalt for similar violations of the Kansas Consumer Protection Act. District Judge Norbert Marek on February 11 ordered Curry to comply with all Kansas consumer protection laws and pay $2,800 in restitution to two Kansas consumers, $120,000 in civil penalties and the cost of the attorney general’s investigation in order to continue doing business in the state.
